Hasipoğlu: Discrepancy between K-PET Board decision and termination procedures
Hasipoğlu announced that they will not accept the notification until the discrepancy in question is resolved.
In a written statement, Minister Hasipoğlu stated that the company’s written notification to the Labour Department was evaluated by the Ministry.
Referring to the meeting held by the Ministry with the parties yesterday, Hasipoğlu noted that the proposal to assign tasks deemed appropriate by the employer to nine employees and to change the work regulations was rejected by the employer.
Hasipoğlu stated that upon this, they evaluated the layoff notification by taking into account the Ministry of Finance’s letter dated October 8.
“THE COMPANY IS A PARTNERSHIP OF TWO PRIVATE PARTNERS AND THE DEVELOPMENT FUND”
Pointing out that the company consists of a partnership between two private partners and the Development Fund affiliated with the Ministry of Finance, Hasipoğlu announced that they assessed that there is a discrepancy in terms of the manner in which the decision was taken and applied between the board of directors’ decision cited as the basis for the mass layoff notification and the procedures initiated for the layoffs.
Hasipoğlu noted that the procedures carried out contrary to the unanimous decision of the board of directors must be clarified regarding the scope of the decision and the will of the company’s authorized bodies.
“Our Ministry will not accept the mass layoff notification for the 9 employees as a duly made notification until the discrepancy between the existing decision and documents is resolved,” Hasipoğlu said, stating that the Ministry will continue to monitor the process within the framework of legislation and protect the legal rights of the employees.
Hasipoğlu used the expressions, “It is unacceptable for any employer to carry out mass layoff procedures outside the scope of decisions taken by the company’s authorized bodies or contrary to the procedures stipulated in the legislation.”
